Terms of Service

1. About These Terms

These Terms of Service ("Terms") govern your use of the Emaliz platform ("Service"), operated by СислеЛабс ООД (SisleLabs OOD), ЕИК: 208739066, with registered address at с. Звъничево (4415), ул. Десета, 4, Bulgaria ("we", "us", "our").

By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Description of Service

Emaliz is a newsletter feedback analytics platform. It allows newsletter writers to embed an HTML snippet in their emails so readers can express sentiment with a single click. Writers see aggregated feedback on a dashboard — sentiment scores, trends, and per-edition breakdowns.

3. Account Registration

You must provide a valid email address and create a password to use the Service. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. You must notify us immediately at [email protected] if you suspect unauthorized access.

4. Payment Terms

Emaliz offers free and paid plans. Paid subscriptions are billed monthly via Stripe. All prices are displayed in USD and are exclusive of applicable taxes unless stated otherwise. VAT and other taxes are calculated and applied at checkout based on your billing address.

You authorize us to charge your payment method on a recurring basis. You may cancel your subscription at any time; access continues until the end of the current billing period.

5. Refund Policy

We offer refunds as described in our Refund Policy. Refund requests must be submitted within 14 days of the charge. We reserve the right to deny refund requests that do not meet the criteria set out in that policy.

6. Right of Withdrawal (EU/BG)

Under EU and Bulgarian consumer protection law, you have the right to withdraw from a purchase within 14 days without giving a reason. However, by starting to use the Service immediately upon subscribing, you explicitly consent that the delivery of the digital service begins right away and acknowledge that you lose your right of withdrawal once the service has been fully provided.

At checkout, you will be asked to confirm: "I agree that the digital service begins immediately and I waive my 14-day right of withdrawal."

7. Intellectual Property

All content, code, design, and branding of the Service are owned by SisleLabs OOD or its licensors. You retain ownership of the data you input into the Service (newsletter names, campaign names, etc.). By using the Service, you grant us a limited license to process your data solely for the purpose of providing the Service.

You may not copy, modify, distribute, sell, or lease any part of the Service or its underlying software.

8. Acceptable Use

Your use of the Service must comply with our Acceptable Use Policy. We may suspend or terminate your account if you violate these Terms or the Acceptable Use Policy.

9. Account Termination

You may delete your account at any time by contacting us at [email protected]. We may also terminate or suspend your account if you breach these Terms, engage in abusive behavior, or if we are required to do so by law.

Upon termination, your access to the Service ceases immediately. We will delete your personal data in accordance with our Privacy Policy, subject to legal retention obligations.

10. Limitation of Liability

To the maximum extent permitted by applicable law, SisleLabs OOD shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

  • Your use of or inability to use the Service;
  • Any unauthorized access to or alteration of your data;
  • Any third-party conduct on the Service;
  • Any other matter relating to the Service.

Our total aggregate liability shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Arbitration (US Customers)

If you are located in the United States, any dispute arising from or relating to these Terms or the Service shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. Arbitration will take place in English, and the arbitrator's decision shall be final and binding.

You agree to waive any right to a jury trial or to participate in a class action. This arbitration clause does not prevent you from bringing issues to the attention of federal, state, or local agencies.

12. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the Republic of Bulgaria. For users outside the United States (where arbitration applies), any disputes shall be submitted to the exclusive jurisdiction of the courts of Plovdiv, Bulgaria.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice on the Service. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
